The Biden administration had to reinstate the MPP policy
President Biden’s administration has never agreed with the MPP policy and, in fact, permanently rescinded it by memorandum in June 2021.
However, a Texas federal judge intervened in the case and, in mid-August, stated that the Biden administration had not followed regular protocol when removing this policy and, therefore, should reimplement it as soon as possible.
When Biden attempted to appeal this ruling, the US Supreme Court upheld the Texas judge’s verdict, forcing his administration to reinstate the MPP program.

Advocates: Biden blindly accepted the MPP reinstatement
Dozens of immigrant rights advocates are disappointed with the Biden administration’s decision to blindly accept the Texas judge’s order calling for the reimplementation of the MPP policy.
They state that this rule jeopardizes the integrity of people in urgent need of international protection. This is because, under the MPP policy, asylum seekers:

The Biden administration tries to prove otherwise
Biden’s DHS (Department of Homeland Security) issued a new memo in late October, attempting to incorporate the Texas judge’s concerns in order to rescind the MPP policy again.
Since litigation is pending, it is still uncertain whether the new memo meets the requirements necessary to permanently remove this rule.
