Asylum Applications Might be Processed by DHS Officials under Biden
Alarming backlog of pending asylum cases
As a result of the global Coronavirus pandemic and hundreds of changes made by the Trump administration to the entire immigration system, the US currently has a rather alarming backlog of immigration cases, especially when it comes to humanitarian programs such as political asylum and refuge.

Biden may allow DHS officers to process asylum requests
On Tuesday, July 6, 2021, the Biden administration published a notice on the Office of Information and Regulatory Affairs website, called “Procedures for Credible Fear Screening and Consideration of Asylum, Withholding of Removal and CAT Protection Claims by Asylum Officers”. This notice means that the Biden administration plans to soon begin the process to publish an NPRM (Notice of Proposed Rulemaking).
According to a recent Bloomberg Government report, under this proposal, the Biden administration might allow asylum seekers to present their cases before a DHS (Department of Homeland Security) official, instead of waiting until there is availability to request an appointment with an immigration judge.
The Biden administration seeks to reduce the backlog of immigration cases, expedite the processing of political asylum applications, decrease the workload for immigration judges across the US, and ultimately improve the overall immigration system overall.
Once this proposal is officially published, the American public will have the opportunity to provide input regarding this rule. If the Biden administration succeeds in carrying out this proposal, the DHS would be responsible for the initial screening process for eligible asylum seekers.
