Biden makes good on promise to appeal DACA decision

On Friday, September 10, 2021, Biden’s DOJ (Department of Justice) filed a Notice of Appeal in the Fifth Circuit Court of Appeals, asking to reverse federal Judge Andrew Hanen’s decision on DACA (Deferred Action for Childhood Arrivals).

It is important to explain that DACA is a deportation relief program implemented in 2012 by the Obama administration, which protects young immigrants known as Dreamers for two years with the possibility of extension.

When Judge Hanen suspended new enrollments in the DACA program in mid-July, President Biden issued a statement, promising that his administration would challenge the judge’s decision.

Why did the judge in charge of the case decide to suspend DACA?

Judge Hanen, for the Southern District of Texas, stated that the Obama administration did not follow regular protocols when implementing DACA in 2012 and, therefore, it is an illegitimate program.

According to the Texas judge’s verdict:

• Initial DACA applications cannot be approved.
• Dreamers who are already DACA recipients are not affected by the verdict, but their future is still uncertain.
