The government of the US has the power to use federal entities to fulfill its purposes and redirect their tasks depending on its goals and promises. For instance, the current administration, with President Donald Trump leading, has always had the goal of reducing immigration in the country, both legal and illegal.

Thus, it has used border agencies such as Immigration and Customs Enforcement (ICE) to curb illegal immigration at the borders, detain undocumented foreigners across the US, and initiate deportation proceedings for them. In fact, ICE has played an essential role during Trump’s term, who has hired more than 10,000 border agents, greatly expanded the immigration detention system and mass deportations, increased investigations and operations conducted by ICE, inter alia.

ICE, which is one of the branches of the Department of Homeland Security (DHS), not only protects the borders, but is also in charge of supervising immigration detention centers around the US and deportation proceedings for undocumented immigrants, and conduct thorough investigations to locate immigrants who have participated in crimes or could pose a threat to the local population.

Cooperation between ICE and law enforcement entities

One of ICE’s strategies is to create alliances or agreements with law enforcement entities of each state, such as the police department, to have a cooperative approach and be able to detain undocumented immigrants with the help of these entities.

Therefore, in many states, ICE has the power to detain undocumented foreigners inside jails, prisons or correctional facilities. Other than that, law enforcement agencies, if they decide to cooperate with ICE, can detain undocumented immigrants under specific scenarios.

This cooperation is possible because of the Trump administration’s stance when it comes to immigration. During other administrations, such as Barack Obama’s, ICE could detain immigrants who posed a threat to the local population, but not those who simply did not have legal documentation.

However, ICE’s approach under the Trump administration has undoubtedly instilled fear and anguish among immigrant communities, who avoid contact even with non-border law enforcement entities.

There are some exceptions, such as “sanctuary cities or jurisdictions,” that do not allow cooperation with border entities like ICE.

The Biden administration could change ICE’s methods and approach

A recent report from the American Civil Liberties Union (ACLU), called “The Biden Administration Can Make Us All Safer: End ICE Collaboration Programs,” states that the incoming government must change ICE protocols to stop instilling fear among undocumented immigrants.

ACLU proposes to end cooperative programs between ICE and law enforcement agencies of each state. These agencies have different duties, such as protecting local residents regardless of their immigration status, and should not focus their efforts on detaining undocumented immigrants.
