Executive Action 13768 – Brief Explanation
It is no secret that the political identity of former President Trump is strongly related to his stance on immigration and the ideal of reducing the number of foreigners entering the US. Therefore, since taking office in 2017, he has used all the tools at his disposal to restrict immigration, both legal and illegal, and directed multiple federal entities such as DHS (Department of Homeland Security), ICE (Immigration and Customs Enforcement) and USCIS (US Citizenship and Immigration Services) to serve this purpose.
For instance, on January 25, 2017, 5 days after taking office, former President Trump signed an Executive Order (executive order 13768) called “Enhancing Public Safety in the Interior of the United States,” which outlines a series of changes on immigration enforcement within the country.
Former President Trump asked several federal entities to use all the tools, systems and resources available to ensure the removal (deportation) of undocumented immigrants who managed to cross the borders and currently reside in the US without legal documentation, mainly those who engage in a criminal conduct or have pending legal charges.
Adding to that, through this Executive Order, former President Trump stated that “Sanctuary” cities or states could not receive federal funds except as required by law because, in his opinion, they violate the US’ immigration enforcement policies. These jurisdictions normally adopt local policies or laws to prevent law enforcement agencies from cooperating with border entities like ICE.

Biden revokes Executive Action 13768
The president elected by the American population in November 2020, Joe Biden, took office two days ago, on January 20, 2021. During his first day in office, President Biden signed multiple executive orders and issued presidential memoranda to revoke Trump’s policies in different sectors, such as immigration.
It is important to clarify that Biden has a diametrically opposite position to Trump when it comes to immigration and promised to remove current restrictive policies in order to restructure the entire immigration system over the next four years.
Thus, one of his first decisions as President of the US was to revoke order 13768 through another executive order called the “Executive Order on the Revision of Civil Immigration Enforcement Policies and Priorities.” Through this statement, President Biden declared that the priority of his administration is to protect national and border security, but also to ensure the well-being of vulnerable communities.
Accordingly, his administration “will reset the policies and practices for enforcing civil immigration laws to align enforcement with these values and priorities.” This executive order also directs the leaders of several federal departments and agencies to take appropriate action to reform immigration enforcement within the US.
