What are the obstacles Biden faces in Congress?
Biden is using every resource at his disposal to offer a path to citizenship to Dreamers, provided they meet certain eligibility requirements. Nevertheless, his administration faces several gigantic challenges in Congress, especially in the upper chamber, the Senate.

The reconciliation process
The Biden administration is considering using the reconciliation process to include an immigration resolution in a budget package. This process would allow it to circumvent the Republican filibuster and implement the budget bill with only 51 votes in the Senate, instead of 60.
However, several members of Congress have stated that the Senate will most likely not allow an immigration legislation in a budget package. Regarding this comment, the Biden administration argues that this immigration resolution will protect essential workers and boost the economy in times of crisis.
The border situation
Several members of Congress openly state that they do not plan to support any immigration bill until the border situation improves. By this, we refer to a surge of illegal border crossings that has taken place since the end of 2020, but which has intensified since Biden took office in January 2021.
