Court Allows Termination of Title 42
Court of Appeals allows Biden to lift Title 42
The D.C. Court of Appeals made its final decision on Title 42 last Friday, giving the Biden administration the green light to lift this border restriction.
To understand the issue at hand, it is important to explain a couple of things:
- The Trump administration implemented Title 42 in early 2020 with the advent of the global Coronavirus pandemic.
- Title 42 allows for express deportations in the midst of the health crisis, denying the vast majority of migrants the ability to file asylum claims at the borders.
- The Biden administration has kept this rule active until now, even after the health risk subsided.
- Advocates who challenged this border rule claim that, instead of being a public health measure, Title 42 has become an arbitrary deportation rule.

Is the US ready to lift Title 42?
Experts and political leaders are concerned about the possible termination of Title 42, especially since there is a massive wave of irregular migration into the borderlands, which could overwhelm the immigration system if this regulation is not in place.
Despite the controversy, the Biden administration has not yet declared anything on the matter and, according to the initial plan, Title 42 will be lifted on December 21 unless there is another appeal.
