Courts Rule Against Biden’s Immigration Policies
Biden tries to move forward on immigration
President Joe Biden has big plans regarding the immigration sector and has tried, since January 2021, to remove certain restrictive policies implemented by his Republican predecessor to pave the way for comprehensive immigration reform.
In fact, the Biden administration is simultaneously acting on multiple aspects and branches of the local immigration system. On the one hand, Biden and his team have proposed several strategies to improve existing legal immigration programs, while trying to manage and address the most alarming surge of illegal border crossings in decades.
On the other hand, several opposition groups and certain Republican leaders have tried every means possible to intervene and interdict Biden’s immigration plans through legal processes that delay his administration’s proposals.

Several Courts intervene in Biden’s immigration plans
Currently, the Biden administration is facing an unprecedented challenge when it comes to immigration, especially as border apprehension rates continue to rise exponentially and several local courts have recently ruled against its immigration plans.
Let’s look at a few examples:
The reinstatement of the MPP policy
On August 13, a Texas federal judge, who was appointed by former President Donald Trump, ordered the Biden administration to reinstate the MPP (Migrant Protection Protocols) policy, also known as “Remain in Mexico”, which was initially implemented by Trump in 2019.
This policy forces asylum seekers to remain in Mexican territory while they receive a response to their immigration cases. Under this rule, asylum seekers live in truly precarious conditions and at the mercy of local gangs.
The Supreme Court recently paused the Texas judge’s order, but the future of this policy is still uncertain.
Guidelines for ICE officers
Earlier this year, the Biden administration proposed a series of guidelines and protocols for ICE (Immigration and Customs Enforcement) officers, which substantially lowered deportation levels, drawing attention among opposition groups.
Recently, a federal judge, interestingly also from Texas, blocked the guidelines set by the Biden administration for ICE officers.

As one might realize, the most recent intervention of different federal courts is mainly related to irregular migration, even when it comes to asylum seekers who try to enter the US without authorization to seek international protection, which is also quite controversial.
However, in addition to being a contentious issue, irregular migration does not really bring positive repercussions and, on the contrary, it is an extremely dangerous journey that could jeopardize your future in the US.
Therefore, when starting or completing an immigration process of any kind, it is imperative that you follow the advice of experts who know the local immigration system and have the tools to lead you towards the success of your application in the shortest possible time.
