August: Biden added more than 11,000 asylum cases to his Dedicated Docket

A recent report from TRAC (Transactional Records Access Clearinghouse) reveals that the Biden administration added a total of 11,847 political asylum applications from immigrant families to its Dedicated Docket in August 2021.

According to the report, the Biden administration added approximately 400 individuals per day to the immigration Court’s docket, which is a substantial increase from July, when about 140-150 individuals were added to the new Dedicated Docket per day.

What is the Dedicated Docket?

At the end of May 2021, Biden’s DHS (Department of Homeland Security), along with DOJ’s (Department of Justice) EOIR (Executive Office for Immigration Review), announced a new process called Dedicated Docket, which aims to process asylum applications of immigrant families in record time.

According to the Biden administration’s plan, immigrant families added to the Dedicated Docket would receive a response to their asylum applications within 300 days of filing their cases.

Also, in the eyes of the current administration, this plan would substantially reduce the backlog of asylum cases across the US and waiting times for immigrant families.

What are the TRAC report’s findings?

TRAC states that the number of cases added to the Dedicated Docket in August could represent an overwhelming workload for immigration officers or judges who handle asylum claims for immigrant families.

Adding to that, if the time limit is 300 days to resolve these cases, “new questions emerge about whether these cases will be completed fairly and within the promised timeline, whether Immigration Judges will be able to manage large Dedicated Docket caseloads, and whether the Court is reliably tracking these cases as promised.”
