Democrats to Introduce ‘Plan C’ for Immigration Reform in Budget Package
Two failed attempts to promote immigration reform
The Biden administration and certain Democratic members of Congress have worked tirelessly to restructure the local immigration system in general, which clearly includes irregular migration and foreigners residing in the US undocumented, a number that currently hovers around 11 million.
In fact, one of the main goals of Democratic leaders is to protect essential undocumented workers by opening a path to citizenship for them, allowing them to work legally and boost the national economy through social responsibilities that come with legalization.
As expected, Biden’s immigration reform faces gigantic obstructionism in Congress, more specifically in the Senate, and that is why his administration decided to introduce the path to citizenship in the most recent budget package, which could pass with only 51 votes through the reconciliation process.
However, the Senate Parliamentarian recently rejected two immigration proposals introduced by Democrats in the spending bill, stating that the immigration language used was not entirely a budgetary issue.

Democratic leaders’ immigration proposals
Open Path to Citizenship
Initially, Democratic leaders proposed to invest $107 billion to, among other things related to the immigration system, open a path to citizenship for undocumented foreign workers.
On September 19, the Senate Parliamentarian rejected this immigration language, stating that it was not appropriate to include it in the budget package.
Registry Provision
The Democratic leaders’ ‘Plan B’ proposed to modify the registry provision in the INA (Immigration and Nationality Act), which would allow certain immigrants to access lawful permanent residency, as long as they have lived in the US for a specified period of time.
On September 29, the Senate Parliamentarian also rejected this immigration language, stating that it should not be included in the budget package as it is, in essence, an immigration policy change.

Democrats propose ‘Plan C’ to enact immigration reform
In one of our most recent articles we talked about the possibility of Democratic leaders introducing a new proposal to present to the Senate Parliamentarian, although it should be clarified that her opinion is not an order.
Well, now it’s official. Democratic leaders recently confirmed that they are finalizing the adjustments necessary to modify the immigration resolution in the budget package and hope that the Senate Parliamentarian will accept it this time.
Broadly speaking, Democrats plan to expand their parole power to grant amnesty to approximately 8 million undocumented immigrants for five years, with the possibility of extension.
