Extension and Re-Designation of TPS for Yemeni Nationals
DHS extends and re-designates Yemen for TPS
On Tuesday July 6, 2021, Alejandro Mayorkas, Secretary of DHS (Department of Homeland Security), announced the extension and re-designation of Yemen for TPS (Temporary Protected Status) for 18 months, which will take effect on September 4, 2021, and will be valid until March 3, 2023, with the possibility of extension.
Under this new designation, Yemeni nationals currently residing in the US who meet certain eligibility requirements will be able to apply for the extension of TPS if they are already beneficiaries of this program or apply for TPS for the first time.
According to official DHS figures, this extension will allow approximately 1,700 Yemeni nationals to retain their TPS until 2023, that is, extend this benefit, and the re-designation will allow approximately 480 Yemeni nationals to submit their initial TPS applications.
To keep in mind:
- One of the main requirements to be able to apply for the re-designation of TPS for Yemen is to have continuously resided in the US since July 5, 2021, and to have been continuously physically present in the US since September 4, 2021 .
- To apply for the TPS extension, Yemeni nationals who are already TPS beneficiaries “should re-register in a timely manner during the 60-day registration period”.
- Once DHS officially publishes the extension and re-designation of Yemen for TPS in the Federal Register, Yemeni nationals eligible for re-designation will be able to submit their applications during the initial registration period.

Protection from deportation for Yemeni nationals
It is important to explain that TPS is a deportation relief program, which is granted by DHS to nationals of certain countries that are going through precarious and risky situations such as ongoing armed conflict, epidemics, natural disasters, inter alia.
The Secretary of DHS has the power, right, and duty to grant TPS for certain vulnerable territories. In this way, this entity prevents nationals of these countries, who are deported from the US, from going through dangerous situations.
For instance, Mayorkas decided to extend and re-designate Yemen for TPS due to “ongoing armed conflict and extraordinary and temporary conditions in Yemen, including lack of access to food, water, and healthcare (…) These conditions prevent Yemeni nationals and habitual residents from returning to Yemen safely”.
TPS allows nationals of countries designated by DHS to reside in the US for a specified period of time without being at risk of deportation, even if they do not have legal documentation, that is, if they entered the country without prior authorization. Adding to that, TPS beneficiaries also have the possibility to apply for an EAD (Employment Authorization Document) and be part of the local workforce.
