For instance, speaking specifically about the current administration of the US, with President Donald Trump leading, entities that have helped meet its immigration goals are primarily branches of the Department of Homeland Security (DHS).

During Donald Trump’s term, ICE has played a key role as his administration has redirected and refocused its efforts to increase mass deportations, operations to detain undocumented immigrants and change immigration enforcement in the US.
Therefore, due to the nature of its duties and guidance from the Trump administration, ICE has been involved in several legal processes in recent years, as well as in a gigantic social controversy.
Adding to that, the Trump administration has received countless criticism for the way it handled immigration and border entities over the past four years, primarily ICE.

- The Trump administration invested large amounts, from taxpayers, in contracts with private prison companies to be able to detain undocumented immigrants in their facilities, on behalf of ICE, and carry out mass deportation proceedings.
- Immigrant detention centers, regardless of whether they belong to ICE or third-party companies, are currently overcrowded and do not have enough resources to protect the well-being and health of both detainees and federal employees.
This situation worsened after the arrival of the global COVID-19 pandemic, which threatened the health of thousands of immigrants in ICE custody and the massive outbreak at these facilities was, and still is, truly alarming.

Biden could change ICE’s approach to immigration and deportation
The American population elected Joe Biden, belonging to the Democratic political party, as the next president of the US, who will take office on January 20, 2021.
It is important to clarify that Biden promised to restructure the immigration system, overturn Trump’s restrictive policies and protect the most vulnerable immigrant communities, which were tremendously affected under the current administration.
Regarding these promises, the Journal of Diplomacy and International Relations recently stated that Biden’s proposals are not sufficient to improve immigration enforcement within the US and limit ICE’s power over human rights, but rather, “The Biden administration has an opportunity to dismantle the prior administration’s cruel immigration and detention policies, and they can start by abolishing detention centers, substantially reducing the budget for ICE, and relaxing the criteria for those held in detention (…) Action must be taken, and policies that fail to protect the human rights of migrants must be met with scrutiny.”
