H-1B Visa Approval Rate Increases
The global pandemic and the Trump administration affected business immigration
Former President Trump’s administration made it clear that its goal regarding immigration was to reduce the flow of foreign nationals into the US at all costs. To achieve this goal, the previous administration used every resource and tool at its disposal to implement a series of policies that restricted, limited, narrowed and hindered most existing immigration processes.
Thus, one could argue that Trump’s actions affected certain immigration programs more than others, but the reality is that the entire immigration system went through a series of fairly prominent changes between 2017 and early 2021.
Speaking specifically about business immigration, visa programs for foreign workers have always been a fundamental tool for the socioeconomic development of American or US-based companies.
For instance, the H-1B visa for highly skilled foreign workers in sectors such as science, technology and engineering is a pillar for the US’ international competitiveness. However, despite being quite valuable to the nation, this program was tremendously affected by the Trump administration’s rules and subsequently by the arrival of the global Coronavirus pandemic.

H-1B visa approval rate increases under the Biden administration
The current administration of the US, headed by President Joe Biden, has always emphasized the need to open the doors to foreign workers, especially considering high unemployment rates in sectors such as technology, which are related to the lack of skilled workforce.
Therefore, President Biden, since January 2021, has removed a large number of restrictions implemented by his Republican predecessor on business immigration processes. As a result, H-1B visa approval rates for high qualified foreign workers have increased substantially during the second half of the Fiscal Year (FY – October/September).
According to official figures:
- In 2018 and 2019, under the Trump administration, the H-1B visa approval rate was approximately 84%, a rather low figure compared to the need and demand of American companies to hire skilled workers in certain sectors.
- During FY 2021, the second half under the Biden administration, the H-1B visa approval rate increased to 97% – 98%. This is because, after the arrival of the global pandemic, the demand for highly qualified foreign workers increased and, at the same time, the Biden administration is improving the processes available for local companies to hire workers from abroad without going through many bureaucratic hurdles.
