House reconciliation plan seeks to reuse Green Cards
Currently, there is a House reconciliation bill pending review by the Senate Parliamentarian, which proposes to reuse Green Cards to reduce the backlog of immigration cases across the US.
It is important to explain that Green Cards grant LPR (Lawful Permanent Resident) status to immigrants who meet certain eligibility requirements.
Usually, since the US issues only a fixed number of Green Cards annually per country, there is a long waiting list for hundreds of thousands of nationals from certain countries with high rates of migration to the US or high population density such as India, which can last for decades.
At the same time, there are countries across the world that do not reach their Green Card annual cap, and therefore they are often lost as they are not reusable.
Thus, the Chamber’s reconciliation plan seeks to, among other things:
- Issue Green Cards based on employment or family ties that were not used during the last three decades.
- Allow certain applicants to pay high fees to avoid Green Card waiting times.
If passed, these provisions in the House reconciliation bill would benefit approximately 4 million foreigners who are on the waiting list for family-based Green Cards, and approximately 1 million foreigners waiting for employment-based Green Cards.
