ICE Extends Flexibility for Local Employers
Extension to complete the virtual I-9 flexibility
The Immigration and Customs Enforcement Service (ICE) announced last Tuesday, June 16, 2020, that the flexibility to submit the I-9 form is extended for another 30 days.
This is excellent news for local employers as they will have the opportunity to present the necessary documentation and be able to hire specialized foreign workers in specific areas of the American market.
This extension will be valid until July 18, 2020. It is essential for you to take advantage of the extension and prepare your documentation correctly.

The peculiarity of the I-9 form
The I-9 form is different from other forms that must be presented to the US Citizenship and Immigration Service (USCIS).
This form must be completed and the local company or employer must keep the document to present in the event of a sudden inspection of entities such as:
- Department of Labor (DOL).
- Department of Homeland Security (DHS).
- Department of Justice (DOJ).
Typically, employers have this document ready to show to any of these entities to verify that employees have a valid work permit in the US.
With this form, the employees’ identity is verified, as well as their legal work status in the country.
Employers must have an I-9 form for each of their employees, whether they are legal citizens or foreigners.

The Form I-9 process changed in light of the pandemic
Due to the arrival of the global Coronavirus pandemic, government entities are unable to do face-to-face monitoring to verify that the employees of a local company have legal work permits in the US.
That is why, because of the health crisis, the I-9 form must be completed virtually during the current juncture. This is a temporary measure implemented by ICE as the threat to public health diminishes.
Important clarifications
This remote version is active only for companies that are also working remotely. If the services offered by a company are not active due to the health crisis, online monitoring of the I-9 form is not necessary.
