Immigration Expectations with the Incoming Administration
Immigration under the Donald Trump administration
One of the pillars of President Donald Trump’s political campaign to win the 2016 election was immigration. His stance, vision and expectation of how the federal government should approach and manage the local immigration system has led to the implementation of more than 400 changes to immigration policies, which transformed and substantially restricted alternatives available to foreigners who plan to come to the US for the first time or those already residing in the country, with or without legal documentation.
Immigration has never been a simple issue among the American population, rather, it has always created quite a controversy. However, under other administrations, immigrants had more legal possibilities to request documentation in the US, including foreigners who crossed the borders without legal documentation and yearn to apply for political asylum or employment authorization after entering the country.
With President Donald Trump leading the current administration of the US, immigration processes changed considerably, deportations increased disproportionately, immigration detention centers are massively overcrowded, undocumented immigrants do not have many alternatives to protect their future in the US even if they pay annual taxes and the most vulnerable immigrant communities such as asylum seekers are experiencing precarious situations due to policies implemented during the last four years.

Immigrant communities expect radical change with Biden
Despite President Trump seeking re-election on November 3, 2020, the American population elected Democratic candidate Joe Biden as the nation’s 46th president, who will take office on January 20, 2021, known as Inauguration Day.
Biden’s stance on immigration contradicts Trump’s opinion. The Biden-Harris government assures that immigration is extremely positive, and even more now in times of crisis. Therefore, the president-elect plans to revoke Trump’s restrictive policies on the immigration sector, protect the most vulnerable immigrant communities, increase alternatives for highly qualified foreign workers and international students, and allow undocumented immigrants, who are also part of the local workforce, to obtain legal residence permits.
According to a recent Forbes report, the incoming government could positively impact and improve the local immigration system through, among others:
- Employment-based visas. The Trump administration banned the issuance of H-1B visas and L visas on health crisis grounds. These visas allow local companies to hire highly skilled foreign workers and make inter-company transfers. Typically, H-1B Visa holders are professionals in STEM (Science, Technology, Engineering and Mathematics) fields.
The Biden administration plans to lift Trump’s restrictions on business immigration and allow foreign workers, along with local workers, to boost the economy in times of crisis. - Expand opportunities for international students. The Trump administration severely restricted student immigration during the massive Coronavirus outbreak, affecting local universities and colleges, which heavily rely on investment and talent from foreign students.
The Biden government must take into account foreign students as, apart from their financial investment, they tend to become highly qualified local workers.
