Is Biden Expanding the MPP Policy?
Did the Biden administration reimplement and also expand the MPP?
There is growing uncertainty among immigrant rights advocates and activists as the Biden administration reimplemented and apparently expanded the MPP (Migrant Protection Protocols) policy.
According to recent press releases, the Biden administration is expanding the MPP rule to include asylum seekers who are not from Spanish-speaking countries, which would increase the number of people enrolled in this program.
Let’s take a look at the background of the situation:
The MPP policy – Brief explanation
The Trump administration implemented this program in 2019, which states that migrants arriving at the borders to request political asylum in the US must wait in Mexican territory until they receive an answer to their immigration cases. In fact, this policy is also known as “Remain in Mexico”.

The Biden administration’s steps to rescind the MPP policy
Earlier this year, the Biden administration suspended enrollment in the MPP program and then unveiled a resettlement plan for asylum seekers still waiting in Mexico.
Subsequently, Biden’s DHS (Department of Homeland Security) permanently rescinded this policy in June 2021, stating that it was inefficient and inhumane.

Judge orders the MPP reimplementation
In August, a Trump-appointed federal judge in Texas, responding to a lawsuit, stated that the Biden administration failed to follow regular protocols when it terminated the MPP policy and thus ordered its immediate reimplementation.

Biden reinstates the MPP policy
On December 2, the Biden administration announced that it had reached agreements with the Mexican government and, following the federal judge’s order, would reinstate the MPP policy this week.
It is important to clarify that the MPP program version implemented by the Biden administration includes new conditions and parameters, which were outlined by the Mexican government in light of humanitarian concerns.
However, the fact that Biden has expanded the program raises questions among the local population and calls into question his administration’s intentions.

Biden takes new action to end this program
In late October and in the midst of the controversy over the MPP reimplementation, DHS issued a new memorandum to rescind this program again, this time following the judge’s comments regarding the regular process.
This action by the Biden administration is still inconclusive because it is under review and comment period by the American public and because there is pending litigation.
