Judge Postpones Ruling on DACA Program
DACA under the Trump administration
In 2012, with the intention of protecting young immigrants known as Dreamers, then-President Barack Obama implemented an immigration benefit called DACA (Deferred Action for Childhood Arrivals), which is a deportation relief program.
Dreamers are immigrants who came to the US without legal documentation when they were minors. Under DACA, eligible Dreamers may legally reside in the country for two years, with the possibility of extension, and apply to other benefits such as employment authorization permits.
Currently, DACA protects more than 600,000 young immigrants, who are calling for permanent solutions after being on the tightrope for four years under the Donald Trump administration.
Former President Trump disagreed with the idea of offering protection or social benefits to foreigners who cross the US’ borders without legal documentation, regardless of whether they are minors or not.
Thus, between 2017 and 2021, DACA faced multiple legal battles under the Trump administration, which tried to remove it from programs available to immigrant communities, despite the fact that hundreds of DACA recipients remember almost nothing about their home countries and are now essential workers in different important sectors of the local market.

The controversy surrounding DACA continues
After the DACA case reached the US Supreme Court of Justice, which ruled in favor of the Dreamers in June 2020, the legal battle seemed to be over. However, the Trump administration did not fully comply with the Supreme Court verdict and a lower court had to intervene again in December 2020, ordering the Trump administration to reinstate DACA.
However, DACA still had a pending hearing in a Texas court in late December 2020, where the judge handling the case had to decide whether the program itself meets mandatory requirements to be a valid immigration benefit. This legal process is still open.

Texas judge allows both parties involved to present more information about DACA
On Tuesday, March 30, 2021, Texas judge in charge of reviewing the DACA case postponed the ruling and gave the two parties involved (plaintiffs and defenders) the opportunity to present more information and evidence until April 9.
The judge’s verdict will outline the future of thousands of Dreamers currently covered by DACA or those who have already submitted their applications and meet eligibility requirements. However, it is worth mentioning that there are currently several immigration bills under congressional review, which, if passed, would provide permanent benefits and solutions for eligible Dreamers.
