Lasting Immigration Changes Depend on Congress
Biden tries to change the immigration system
Immigration has always been a peculiar and controversial topic in the US and usually occupies an important place for the country’s administrations. For instance, immigration has been a mainstay of the political campaign of both former Republican President Donald Trump and current Democratic President Joe Biden, although they differ greatly in their vision and opinion regarding this essential sector.
President Biden has led the White House since late January 2021, and in just over four months, his administration has made leaps and bounds on the immigration system. In fact, in one of our most recent articles, we talked about the number of immigration-related executive actions issued by Biden in his first 100 days in office, which triple former President Trump’s executive orders in the same period.
The Biden administration’s goal is, initially, to remove restrictions and limitations implemented by the Trump administration on the immigration sector in order to pave the way and enact more just and humane immigration policies in line with the needs of an increasingly interconnected world.
President Biden openly states that the Trump administration negatively affected the most vulnerable immigrant communities and worsened a long-broken immigration system.

Tools Biden has used to restructure certain immigration policies
The current administration of the US has used all the tools at its disposal to remove restrictive policies from the previous administration and expand most immigration processes, especially those related to employment, study and humanitarian programs such as political asylum.
As part of his strategy to repeal strict rules related to the immigration sector, President Biden is using the same resources used by former President Trump, executive actions. By this, we refer to executive orders, official statements, memoranda, presidential proclamations, inter alia.
In fact, many executive actions of the Biden administration have been aimed at revoking the Trump administration’s limitations and rules, which substantially narrow the alternatives available to all kinds of foreign communities.

Lasting immigration policies depend entirely on Congress
It is evident that, just as Biden has been able to remove dozens of restrictions implemented by the Trump administration on the immigration system through relatively simple executive actions, any other administration could remove its policies and rules in the future if it does not go further and carries out strategies to enact lasting immigration policies.
However, the real question is, what does the Biden administration need to promote lasting immigration processes? The answer is in Congress. Both the US House of Representatives and the Senate have the power to pass certain immigration bills to officially become law, which would allow Biden to implement lasting policies and promote long-overdue comprehensive immigration overhaul.
In fact, according to an expert on the subject, “The only lasting way to reform our broken immigration system is through Congress. But that seems impossible right now”. This is because there are currently different opinions within Congress regarding Biden’s immigration proposals, and it might be difficult for his administration to gain bipartisan support there.
Therefore, the Biden administration must now exhaust all the tools and resources at its disposal to promote comprehensive reform and restructure the entire immigration system.
