Biden’s DHS Extends TPS for Eligible Haitian Immigrants
Alejandro Mayorkas, current Secretary of the Department of Homeland Security (DHS), recently extended Temporary Protected Status (TPS) for eligible Haitian nationals for 18 months.
TPS is a deportation relief program that protects nationals of certain countries experiencing precarious situations for a specific period of time. The Secretary of DHS is in charge of choosing TPS beneficiary countries, setting the length of the permit (which varies between 6 and 18 months), and possibly extending this benefit in the future.
Under this new decision, more than 150,000 Haitians currently residing in the US without legal documentation will be able to either extend their TPS or apply for this immigration benefit for the first time. It is important to note that eligible TPS beneficiaries can also apply for an Employment Authorization Document (EAD) and access other social services.
Usually, DHS designates certain countries for TPS depending on local conditions, which might put the safety of immigrants deported from the US at risk. This includes, but is not limited to, ongoing armed conflict, civil war, extreme weather conditions, epidemics, and natural disasters.

Leaders celebrate the DHS decision to extend TPS for Haiti
Several labor and civil rights leaders, as well as certain members of the US House of Representatives and Senators, praised and applauded Biden’s DHS decision to designate Haiti for TPS for 18 months, taking into account current global conditions related to the Coronavirus pandemic and other risky situations for nationals of that territory.
In fact, the Chief Executive Officer (CEO) of the Leadership Conference on Civil and Human Rights openly stated, “We applaud Secretary Mayorkas and the Biden administration for addressing the ongoing humanitarian crisis in Haiti and for honoring their pledge to reinstate Temporary Protected Status for Haitian refugees. This important step is long overdue and the right thing to do.”
