Mexico asks to improve conditions before reimplementing the MPP
The Mexican government is expressing concerns regarding the reimplementation of the MPP (Migrant Protection Protocols) policy and is asking the Biden administration to address certain humanitarian risks before reinstating this rule.
In fact, on Friday, November 26, the Mexican Foreign Minister openly stated, “The government of Mexico has raised various concerns of a humanitarian nature regarding the asylum procedure in the United States”.
It is worth explaining that the MPP or “Remain in Mexico” policy, which was implemented by Trump in 2019, forces asylum seekers to remain in Mexican territory until they receive a response to their immigration cases.

What is the Mexican government asking for?
The Mexican government is asking the Biden administration to, on the one hand:

The Biden administration does not support the MPP policy
The current administration of the US has never supported the MPP policy and, in fact, Biden’s DHS (Department of Homeland Security) permanently rescinded it by memorandum in June 2021.

Judge ordered the Biden administration to reinstate this rule
Although the current administration ended the MPP program, a Texas federal judge, who interestingly was appointed by former President Trump, ordered Biden to reimplement this policy in mid-August.
According to the judge’s opinion, the Biden administration did not follow regular protocols in rescinding this policy. This ruling was upheld by the US Supreme Court.

The Biden administration attempts to remove the MPP again
In late October, Biden’s DHS issued a memo ending the MPP policy again, but this time addressing the judge’s and Supreme Court’s concerns and comments.
It is uncertain whether the new memo will be effective or whether the Biden administration will be able to rescind this program as litigation is still pending.
