New Legislation to Address Visa Overstays in the US

Senator Introduces Three Immigration Bills

Senator Introduces Three Immigration Bills

On March 18, 2021, Republican Senator John Neely Kennedy introduced three immigration bills, which, if approved by Congress, would significantly change the way the federal government approaches different immigration processes.

When introducing these immigration proposals, Senator Kennedy argued that the recent surge of illegal border crossings highlights the need to reform the US immigration system.

It is important to mention that Senator Kennedy recently recommended to President Biden to reuse former President Trump’s immigration policies to control the current situation at the borders.

Let’s look at the main proposals of the Louisiana Senator:

1. Preventing Visa Overstays Act

Senator Kennedy states that “From 2009-2019, the number of visa overstays was double the number of illegal border crossings.” Therefore, under this act, foreigners who remain in the US after their visas expire would face criminal penalties for violating local immigration law.

Foreigners who exceed their period of stay in the US would have to pay a fine of $500 per day, serve a prison sentence of up to one year, or both, depending on each particular case.

2. Visa Lottery Repeal Act

The Diversity Visa Lottery is a program that randomly offers up to 50,000 Green Cards to nationals of certain countries. The Green Card grants Lawful Permanent Residence.

Senator Kennedy proposes to remove this immigration program since the random selection system does not analyze “applicant’s merit, need, employment status or family relations.

3. Ending Sanctuary Cities Act

Sanctuary Cities or Jurisdictions are known for adopting local laws that ban law enforcement entities from cooperating with border agencies or immigration enforcement entities, preventing the deportation of certain undocumented immigrants.

Thus, through this act, Senator Kennedy proposes to offer “legal protections to local law enforcement officers who cooperate with federal officials.”
