New York Plans to File a Lawsuit Against Trump’s Government
Trump’s latest move on immigrant communities
It is well known that the current President of the US, Donald Trump, has certain and strict opinions regarding immigration, especially illegal immigration.
The president assures that the country must try to eradicate illegal immigration at all costs and penalize foreigners who cross the borders without documentation or legal authorization.
In the opinion of the Trump government, undocumented immigrants should not:
- Obtain social benefits or public aid granted by the local government.
- Have the opportunity to obtain a legal residence permit.
- Have the opportunity to apply for citizenship.
- Apply to work permits.
- Use medical services.
- Receive monetary aid from the government, even during the current health crisis.
Thus, during his term, President Trump has tirelessly focused on reducing the benefits offered to undocumented immigrants currently residing in the US, after crossing borders without legal documentation.
In fact, President Trump recently signed a memorandum explaining his latest attempt to exclude undocumented immigrants from government decisions.
The President proposes to exclude undocumented foreigners from 2020 national census
The national census is carried out every 10 years and is used to:
- Count the number of people residing in the US.
- Distribute congress seats to each state.
- Analyze the behavior of the economy in relation to population density.
- Distribute national funds for each state and promote the development of sectors such as medical, military, police, social programs, inter alia.
In the 2020 census, President Trump signed a memorandum stating that undocumented immigrants currently residing in the country should not be considered for congress seat distribution.
With this, the president would exclude approximately 12 million undocumented immigrants, which would greatly affect some states that have a large number of foreigners without legal documentation.

New York is going to file a lawsuit
Letitia James is the New York Attorney General. She stated on July 21 that the state plans to file a lawsuit against President Trump’s memo that prohibits the counting of undocumented immigrants for congressional seat distribution.
She states: “According to the law, anyone residing in the United States during the census, regardless of status, it must be counted (…) We have defeated the president before in court, and we will challenge him one more time on the census”.
It is important to clarify that President Trump and his cabinet are facing several lawsuits simultaneously and this could spark another social controversy in the US.
On top of that, the country is still one of the main epicenters of the global Coronavirus pandemic, and according to critics, President Trump should be focusing his attention on that in order to protect the health of the local population.
The current administration of the US has not given an official response to criticism from New York State, and the case may go to court again.
