Possible Changes to DACA Draw the American Public’s Attention
DHS plans to re-implement DACA from scratch
In late September, Biden’s DHS (Department of Homeland Security) issued a Notice of Proposed Rulemaking, which seeks to re-establish the program called DACA (Deferred Action for Childhood Arrivals).
This action by DHS came after a Texas federal judge ordered the Biden administration to suspend DACA in mid-July, stating that the program was not properly implemented by the Obama administration in 2012.
The judge’s verdict primarily affects immigrants eligible to access DACA for the first time, but does not yet affect people who are already DACA recipients.

DACA currently protects more than 700,000 eligible young immigrants and allows them to remain legally in the US for two years with the possibility of extension.

Why is this program so controversial?
DACA has always generated a gigantic controversy among the American population, especially during the term of Donald Trump, who tried to eradicate this immigration benefit by any means possible.
In fact, the Trump administration suspended DACA and, after a seemingly endless legal battle, had to reinstate it after the Supreme Court ruled in favor of this program in mid-2020.
Therefore, the main reason why DACA creates controversy is because there is a part of the population that does not support the idea of offering protection to undocumented immigrants, but, at the same time, immigrant rights advocates state that it was not the Dreamers’ decision to come to the US without legal documentation and, therefore, they should have access to a fair immigration system.
