The second woman to serve the Supreme Court of Justice
On Friday, September 18, 2020, Ruth Bader Ginsburg (commonly known as RBG), who was the second female judge to serve on the US Supreme Court of Justice, passed away at the age of 87, after battling for several years against cancer.
President Bill Clinton nominated her as a Supreme Court Justice in 1993, and the Senate approved her appointment with 96 votes to 3. Since then, she faithfully served the nation’s legal system and is known for her dedication to equal gender rights and inclusion of vulnerable communities.
In fact, she is known internationally for her constant fight for human rights and has become a pop icon over the past decades, as well as a progressive and liberal icon of feminism around the world.
The Supreme Court of Justice
The US Supreme Court of Justice has nine members (one presiding judge and eight associate justices). Ginsburg was part of a group of four progressive judges, against five conservatives.
Local law states that if a Supreme Court justice retires or passes away, the President of the US has the ability to nominate a candidate to fill that position, which must be approved by the Senate.
The current administration of the US, led by President Donald Trump, has nominated two justices to the Supreme Court in less than four years and this could represent the third nomination.
It is well known that the Trump government is characterized by its conservative ideals when it comes to multiple sectors of society, for instance, immigration.

The immigration sector and the election of a new conservative judge
Currently, there are five representatives of the Supreme Court who lean towards a more conservative position. If President Trump has the opportunity to nominate another Conservative member before the elections, which will take place in November, 2020, the court could be unbalanced because there would be six conservative judges, against three progressives.
It is important to remember that some immigration programs have reached the Supreme Court after seemingly endless legal battles. That is the case of the Deferred Action for Childhood Arrivals (DACA) and RBG was one of the judges who ruled in favor of the immigration benefit and rejected President Trump’s request to remove it.
Thus, there is growing concern among immigrant communities after RBG’s passing, primarily because the Trump administration may continue its purpose of reducing immigration, both legal and illegal, and use the Supreme Court to achieve its objectives.
Democratic presidential candidate Joe Biden and his cabinet are urging for the next member of the Supreme Court to be elected after the presidential election, but the Trump administration is pushing for that to happen as soon as possible.
