Judge lifts Trump’s restrictions on business immigration
Since the beginning of his political campaign, President Donald Trump used immigration as a cornerstone to win the 2016 election. His administration has used every tool at its disposal to curb illegal immigration, restrict several humanitarian programs, and cut benefits for immigrants who crossed borders without prior authorization.
However, the Trump administration has also tried to reduce legal immigration, especially business immigration. In addition to its intention, the sudden arrival of the global Coronavirus pandemic also contributed to the government’s ability to substantially restrict legal immigration processes, reducing opportunities for highly skilled foreign workers.
The Trump government states that local companies often take advantage of the immigration system to pay lower wages to foreign workers and leave American workers behind, increasing the current unemployment rate. That is why his government has tried to restrict business immigration at all costs.
In fact, in early October 2020, amid the health crisis caused by the pandemic, the Trump administration, through the Department of Homeland Security (DHS) and the Department of Labor (DOL) implemented two rules on business immigration:
- Local companies had to pay higher wages to foreign workers.
- Redefine the category “specialized occupation” to narrow possibilities for highly qualified foreign workers.
However, in early December, after multiple legal processes and lawsuits, a California judge lifted these two rules of the Trump administration, stating that these restrictions were implemented in October and, therefore, the global pandemic was not a valid argument to restrict business immigration at the time.
Recognized university celebrates the judge’s ruling regarding business immigration
The University of Rochester joined the lawsuit of October 19, 2020, which called for blocking the Trump administration’s restrictions (mentioned above) on business immigration.
Universities and other institutions involved in the legal process state that the rules implemented by DHS and DOL on the H-1B visa program for highly qualified foreign workers affect, delay and obstruct the economic development and growth of American or US-based companies, which need foreign workforce to overcome the economic crisis brought by the global pandemic.
Therefore, the University of Rochester publicly expressed its satisfaction with the federal judge’s ruling and stated that it is the right decision for the country to receive and welcome talent, innovation and entrepreneurship from abroad.
