“Remain in Mexico” Faces Another Lawsuit
Asylum seekers under current government policies
The Trump administration has always been firmly committed to reducing the number of immigrants entering the US annually, including those in need of international protection as they try to flee precarious and adverse situations such as persecution, violence, war or abuse.
However, even though the country has always had humanitarian policies and programs that welcome and protect the most vulnerable immigrant communities, the Trump government believes that the massive flow of asylum seekers and refugees is an unnecessary burden on the economic system and reduces opportunities for the American population.

The MPP policy
For instance, due to ideals of the current administration when it comes to the immigration sector, in 2019, President Trump signed an agreement with Mexico called the Migrant Protection Protocol (MPP) or “Remain in Mexico”.
Basically, this immigration policy states that asylum seekers who arrive at the borders of the US to request international protection must wait in Mexico while they receive a response to their applications.
In the opinion of the Trump government, most asylum applications are denied because immigrants do not meet mandatory requirements, but they take advantage of long waiting times to work and reside in the US. For this reason, his government wants them to wait outside the country if their requests have not been approved.
The MPP is already in the hands of the Supreme Court of Justice
Current conditions in which asylum seekers live in Mexico caught the attention of activists and immigrant rights advocates, who claim that the Trump administration is violating human rights, leaving them at the mercy of violence and Mexican gangs, without access to food or basic services.
Thus, the great social controversy led the MPP’s policy to the US Supreme Court, which is currently reviewing the case to determine whether or not it can continue.

New lawsuit against MPP
On Wednesday, October 28, 2020, several organizations that watch over immigrants’ rights filed a new lawsuit against the MPP, despite the fact that the Supreme Court of Justice is already involved in the case.
A California court received the legal complaint and one of the activists stated: “Forcing men, women and children to reside in notoriously dangerous Mexican border cities has exhausted the moral and legal foundations of the US asylum law.”
Adding to that, they state that only a small percentage of asylum seekers under the “Remain in Mexico” policy have the opportunity to obtain legal aid, which further reduces the possibility for them to obtain international protection.
