Judge Ordered Biden to Reimplement the MPP Policy

The states of Texas and Missouri filed a lawsuit earlier this year, requesting the reimplementation of the program called “Remain in Mexico”, formally known as MPP (Migrant Protection Protocols).

To better understand the issue at hand, it is important to explain that this policy, which was implemented in early 2019 by the Trump administration, states that asylum seekers should not enter the US without having legitimately received political asylum status from an immigration judge. Under this rule, they must remain in Mexico until they attend their hearings in immigration court or receive a response to their applications, which can take several months.

Between 2019 and early 2021, hundreds of thousands of asylum seekers lived in temporary camps located in the Mexican border territory, where they had to go through truly precarious situations and shortages of basic supplies. When President Biden took office in January 2021, one of his administration’s first actions was to pause and subsequently rescind the MPP policy, declaring it to be inhumane and ineffective.

Returning to the lawsuit’s subject, a federal judge for the Southern District of Texas ruled in favor of the plaintiffs on Friday, August 13 and ordered Biden to reimplement the “Remain in Mexico” program, stating that the current administration did not measure the consequences when lifting this policy. It is worth clarifying that the judge in charge of the case was appointed by former President Trump and has already intervened in several of Biden’s immigration proposals.

Supreme Court Pauses the MPP Reimplementation

A week after the Texas judge’s decision, on Friday, August 20, Supreme Court Justice Samuel Alito Jr. intervened in the MPP case and paused the reimplementation of this policy until Tuesday, August 24 to give the Supreme Court time to thoroughly review the program and rule on the case.

This is quite positive news for the Biden administration, which appealed the Texas judge’s order, but a federal appellate court rejected its request. Thus, the Supreme Court’s intervention might give the current administration the tools it needs to meet its immigration goals, but the future is still uncertain regarding the MPP policy.
