Supreme Court Rules in Favor of Immigrants Again

Supreme Court will review deportation cases

The Supreme Court of Justice will review deportation cases

In light of the massive outbreak of Coronavirus in the US, the Trump administration decided to implement several changes to deportation policies.

For instance, normal deportation protocols are not being fully followed during the health crisis, and immigrants currently arriving at borders are being deported almost immediately.

The government argues that it intends to protect public health and safeguard resources for the local population.

Despite the intention of the current administration of the US to use deportation as a means of social protection, it has generated much controversy and thousands of immigrant rights advocates have raised their voices against this policy.

This controversy is so great that the United States Supreme Court of Justice decided to intervene in various national controversies such as the express deportations during the pandemic.

After a thorough review, the Supreme Court of Justice announced new changes in deportation policies that greatly benefit immigrants who meet certain requirements.

The new deportation policy

Senior officials of the Supreme Court of Justice ensure that immigrants do not always have adequate help and deportation can be against them if they do not present the correct evidence.

Therefore, the Court decided that deportation cases that do not have enough information, details, documentation or evidence can be disputed for a new review.

The stop-time rule

This rule states that if an immigrant has been in the US for more than 10 consecutive years and has a deportation order, that decision can be reversed using the stop-time rule.

The Supreme Court of Justice ordered that before initiating the deportation proceedings, the judge must review whether the immigrant to be deported has been in the country for more than 10 years, in this scenario, a more in-depth review of the specific case should be made and the judge will make a decision according to the analysis performed.
