Supreme Court to Review the Case of Undocumented Immigrants in the Census
The Trump administration’s plan to remove undocumented immigrants from the Census
The US National Census is conducted every 10 years. It has several main purposes such as:
- Count the number of people currently residing in the country.
- Analyze changes in the population density of each state and the behavior of local economy depending on these figures.
- Distribute seats in congress depending on the population density of each state.
- The government must, taking into account the results of the census, allocate funds to each state to invest in social security, infrastructure, economic growth, health system, inter alia.
2020 is one of the census years. However, the Trump administration has started several legal processes in order to remove undocumented immigrants from the national census.
The current administration of the US argues that if immigrants decide to violate local law by crossing borders unlawfully, then, they should not be taken into account in legal processes such as the census, since that would give them benefits without deserving it.
Therefore, the Trump administration has tried to remove them from the census with all the tools at its disposal.
For instance:
- In July 2020, President Trump signed a memorandum to remove undocumented immigrants from the census, congressional count, and distribution of government funds.
- In early September, a New York court rejected the Trump administration’s request, stating that all US residents, regardless of their immigration status, should be counted in the census.
- After the New York court verdict, the Trump administration stated that it would take the census case to the US Supreme Court for further review since, in its opinion, undocumented immigrants do not respect local laws and the government should not offer them benefits.
Adding to that, the Trump administration argues that states that have a higher population density thanks to undocumented immigrant communities often have “sanctuary policies or laws” and are protecting individuals who violate immigration laws by avoiding cooperation with border forces.
Therefore, in the opinion of the president and his cabinet, these states should not have more seats in Congress and national funds for protecting undocumented immigrants.
Supreme Court must decide if undocumented immigrants can be removed from the census
On Monday, November 30, the Supreme Court of Justice will analyze arguments of the Trump administration to remove undocumented immigrants from the census, in a hearing scheduled since the end of September.
The Supreme Court plans to release its verdict no later than the end of the year, so that the distribution of seats in congress and government funds can take place as soon as possible.
