The Trump Administration’s Small Changes on Immigration
The Trump administration’s pressure on immigration
The immigration sector has been one of the main focuses of the current administration of the US. With President Donald Trump leading, more than 400 changes have been implemented on immigration, both legal and illegal.
Some changes are more prominent than others and draw the attention of immigrant rights advocates, activists, critics, immigration attorneys, and non-profit organizations. That is the case of:
DACA
The Deferred Action for Childhood Arrivals (DACA) is a program that offers protection to immigrants who came to the US without legal documentation when they were minors.
The Trump administration has tried to remove this program multiple times, arguing that immigrants who cross borders without legal documentation should not have options to legally reside in the country.
However, despite the Supreme Court ruling in favor of DACA, the Trump administration is not receiving new applications and is renewing existing permits only for one year, instead of two.
TPS
The Temporary Protected Status (TPS) is a program that offers protection to immigrants from countries experiencing epidemics, natural disasters, ongoing armed conflict, inter alia. Typically, the Department of Homeland Security (DHS) states which countries are protected by TPS.
This is one of the programs that the Trump administration has tried to remove from benefits offered to immigrants in the US. In fact, in September 2020, the Ninth Circuit Court of Appeals gave the current administration green light to remove TPS.
Family separation
In 2018, the Trump administration implemented the well-known “zero tolerance policy”, which states that immigrants who attempt to cross borders illegally are committing a crime and will remain in the custody of federal law enforcement entities.
However, local law states that minors cannot remain in the custody of border forces for more than a specified period of time. Thus, since this policy was implemented, the separation of immigrant families at the borders has increased disproportionately, a fact that has undoubtedly caught the attention of hundreds of immigrant rights advocates.
What about small changes?
Tessa Stuart is a journalist for Rolling Stone magazine, who has done extensive research on President Trump’s immigration policies.
Recently, Stuart gave an interview to NPR, an independent media organization, where she states that the most striking changes could be modified with another administration.
However, she says the Trump administration has implemented a large number of small changes in the immigration sector that are difficult to remove, revoke or modify. In fact, she states: “I think what people worry about who are immigration advocates or who are studying these changes is that there are so many smaller changes that have gone under the radar that they might not be able to catch them all.”
