Border rule in the midst of the pandemic
Title 42 refers to a statute that can be used in certain scenarios where public health could be threatened by an external agent, such as the Coronavirus pandemic.
Since 2020, the Trump administration, following the recommendation of CDC (Centers for Disease Control and Prevention), implemented Title 42 as a means to protect the border territory from a massive COVID-19 outbreak.
As a result, this measure has allowed for the immediate deportation of most immigrants arriving at the borders, including asylum seekers. They, to this day, have not had the opportunity to present their cases even though it is an international right.

The Biden administration has not been able to lift this rule
The Biden administration announced in April that it would lift Title 42 by the end of May, but was promptly intercepted by a lawsuit.
A federal judge in Louisiana, who curiously was appointed by former President Trump, blocked Biden’s plan and stated that his administration was not prepared to lift this measure and did not follow the regular process to remove it.
Thus, the question for many experts is, at what point did Title 42 become a border rule and is that legal?
