- Each FY (Fiscal Year – October/September), the USCIS (US Citizenship and Immigration Services) issues only a certain number of Green Cards, which also have a per country cap. However, when the USCIS does not reach the annual limit, unused Green Cards cannot be recaptured the following year.
Thus, if the Senate passes Biden’s budget package, an estimated 157,000 employment-based Green Cards would be available again, offering permanent protection to documented foreign workers.

Temporary deportation relief and employment authorizations
After changing immigration provisions several times, Biden’s BBB agenda now proposes to expand the parole power to offer temporary protection from deportation (for up to 10 years) to approximately 7 million undocumented immigrants.
If passed, this provision would:
- Allow undocumented immigrants to apply for employment authorization while covered by the parole power.
- Offer employment authorization to foreign farmworkers and Dreamers, young immigrants who came to the US without legal documentation as children.
