Young Immigrants Sue Trump’s Administration Over DACA Changes
DACA – Brief explanation
The Deferred Action for Childhood Arrivals (DACA) is a benefit granted to young immigrant communities currently residing in the US, who crossed the borders without legal documentation when they were minors.
This immigration benefit was implemented during the term of President Barack Obama in 2012 and currently protects almost 700,000 young immigrants, commonly known as “Dreamers”.
DACA protects them from possible deportation and allows them to obtain employment authorization and other benefits. This program is normally valid for two years with the possibility of extension.
However, the current administration of the US, led by President Donald Trump, has a radical view about DACA and has substantially modified the program over the past year.
President Trump ensures that granting residency benefits to immigrants who cross the country’s borders without prior authorization, even if they are minors, only encourages and increases illegal immigration, which tremendously affects the economy.

The Trump administration’s changes on DACA
The Trump government has always intended to remove DACA from programs offered to immigrants.
The controversy surrounding this program has been gigantic because the Trump administration has tried to eradicate it on several occasions, but immigrant rights advocates have not allowed it.
In fact, the US Supreme Court of Justice decided to intervene and in June 2020, it ruled in favor of DACA and rejected the Trump administration’s request to remove it.
However, despite the Supreme Court verdict, the Trump administration decided to change certain aspects of DACA in July.
On top of that, in August, the US Citizenship and Immigration Services (USCIS) gave green light to the new rules implemented by the Trump administration, stating that:
- No new DACA applications are currently accepted.
- The permit is now renewable for only one year instead of two.
Clearly, these measures do not follow or comply with the mandate of the Supreme Court and have created gigantic distress among young immigrant communities who are eligible to apply for DACA.
Dreamers group files lawsuit
A group of Dreamers filed a lawsuit against the new rules implemented by the Trump administration on DACA.
They argue that the current administration of the US is violating local law and is disrespecting the country’s constitution by evading the verdict of the Supreme Court of Justice.
The plaintiffs openly request restoration of DACA and ask the USCIS to receive new applications and extend the permit for two years.
They also argue that to deprive this benefit, when they already won the legal battle, is to violate their rights.
